Heineken USA Incorporated (“Heineken,” “We,” “Us,“ or “Our”) respects your privacy and recognizes your desire to safeguard your information. This Privacy Policy describes our practices in connection with information that We collect online and offline, including but not limited to, through websites, software, social media sites and applications controlled by Heineken, as well as through HTML-formatted email messages that we send to you that link to this Privacy Policy (collectively, the “Services”). The section below titled “California Privacy Rights” describes Our practices with respect to the information We collect, online and offline, from California residents.

The Services are intended for people who are 21 years of age or older. If someone under the legal drinking age has provided Heineken with information by obtaining access to the Services in violation of this Privacy Policy and/or our Terms of Use, we request that the parent or legal guardian of that person contact Heineken so We can remove the information from Our records.

Information We Collect

We collect information from you directly, from the devices you use to interact with us, and from third parties. We may combine information from the Services together with other information we obtain from Our business records. We may use and share information that We aggregate (compile statistics that cannot identify a particular individual) or de-identify (strip information of all unique identifiers such that it cannot be linked to a particular individual) at Our discretion.

Information you Give Us

You may provide the following information to us directly:

  • Name, email address, postal address, and phone number;
  • Username/email address and password used to create an account with us;
  • Date of birth which is required to visit our website;
  • Preferred language;
  • Content you may include in survey responses;
  • Information contained in your communications to Us;
  • Information you make available to Us via a social media platform;
  • Information you submit to inquire about or apply for a job with Us; and
  • Any other information you submit to Us.

Information we Collect Automatically

We and partners working on Our behalf may use log files, cookies, or other digital tracking technologies to collect the following information from the device you use to interact with Our Services.

  • Device information, including IP address (which may reveal your location), device identifiers, and details about your web browser.
  • Analytical information, including details about your interaction with our website, applications, and electronic newsletters.
  • Diagnostic information, including web traffic logs.
  • Advertising information, including special advertising and other unique identifiers that enable Us or third parties working on Our behalf to target advertisements to you. Please be aware that Our advertising partners may collect information about you when you visit third-party websites or use third-party apps. They may use that information to better target advertisements to you on Our behalf.
    We may collect the general physical location of your device by, for example, using satellite, cell phone tower or WiFi signals. We may use your device’s physical location to provide you with personalized location-based services and content.
  • Using pixel tags and other similar technologies: Pixel tags (also known as web beacons and clear GIFs) may be used in connection with some Services to, among other things, track the actions of users of the Services (including email recipients), measure the success of Our marketing campaigns and compile statistics about usage of the Services and response rates.
  • Analytics: We use Google Analytics, which uses cookies and similar technologies to collect and analyze information about use of the Services and report on activities and trends. This service may also collect information regarding the use of other websites, apps and online resources.   • Using Adobe Flash technology (including Flash Local Shared Objects (“Flash LSOs”)) and other similar technologies: We may use Flash LSOs and other technologies to, among other things, collect and store information about your use of the Services. If you do not want Flash LSOs stored on your computer, you can adjust the settings of your Flash player to block Flash LSO storage using the tools contained in the Website Storage Settings Panel . You can also control Flash LSOs by going to the Global Storage Settings Panel and following the instructions (which may include instructions that explain, for example, how to delete existing Flash LSOs (referred to as “information” on the Macromedia site), how to prevent Flash LSOs from being placed on your computer without your being asked, and (for Flash Player 8 and later) how to block Flash LSOs that are not being delivered by the operator of the page you are on at the time). Please note that setting the Flash Player to restrict or limit acceptance of Flash LSOs may reduce or impede the functionality of some Flash applications.

Information from Other Sources

We may collect information about you from other online and offline sources, such as public databases, data brokers, joint marketing partners, social media platforms (including from people with whom you are friends or otherwise connected) and from other third parties. For example, if you elect to connect your social media account to your website account, certain information from your social media account will be shared with Us, which may include information that is part of your profile or your friends’ profiles.

How We Use Your Information

We may use any of the information We collect for the following purposes:

  • Service functionality: To respond to your inquiries; fulfill your requests and process your transactions; provide you with related customer service; send administrative information to you, such as information regarding the Services and changes to our terms, conditions and policies.
  • Service improvement: To conduct data analysis and audits; develop new products; enhance, improve, or modify our Services; identify usage trends; determine the effectiveness of Our promotional campaigns; and operate and expand our business activities.
  • Advertising and marketing: To send you marketing communications that We believe may be of interest to you; personalize the advertisements you see on Our Services and third-party online properties; measure the effectiveness of our advertising. (We may share your information with business partners, online advertising partners, and social media platforms for this purpose).
  • Personalization: To personalize your experience on the Services by presenting products and offers tailored to you.
  • Contests and Promotions: To allow you to participate in sweepstakes, contests and similar promotions and to administer these activities. Some of these activities have additional rules, which could contain additional information about how We use and disclose your information. We suggest that you read any such rules carefully.
  • Social sharing: To facilitate social sharing functionality.
  • Security: To protect and secure Our Services, assets, network, and business operations; and detect, investigate, and prevent activities that may violate Our policies or be fraudulent or illegal.
  • Legal compliance: To comply with legal process, such as warrants, subpoenas, court orders, and other lawful regulatory or law enforcement requests; enforce our terms and conditions; protect our rights, safety, or property and/or that of our affiliates, you, or others; and comply with applicable legal requirements.

How We Share Your Information

We may share any of the information We collect with the following recipients:

  • Affiliates: We share information with other members of our group of companies for the purposes described in this Privacy Policy.
  • Service providers: We engage vendors who perform specific business functions on Our behalf, such as website hosting, data management and analysis, order fulfillment, information technology and related infrastructure provision, customer service, email delivery, auditing and other services. These vendors are obligated by contract to use information that We share with them only for the purpose of providing these business functions.
  • Business partners: From time to time, We share your information, including contact information, with third parties that co-sponsor or co-brand activities with Heineken, including to permit them to send you marketing communications, as well as with third-party sponsors and administrators of sweepstakes, contests, and similar promotions.
  • Online advertising partners: We partner with companies that assist Us in advertising Our Services, including partners that use cookies and online tracking technologies to collect information to personalize, retarget, and measure the effectiveness of advertising. See below under “Choices and Access” for information regarding these practices and how to opt out of them.
  • Social media platforms: If you interact with Us on social media platforms, the platform may be able to collect information about you and your interaction with Us. If you interact with social media objects on Our Services (for example, by clicking a Facebook “like” button), both the platform and your connections on the platform may be able to view that activity. To control this sharing of information, please review the privacy policy of the relevant social media platform.
  • Readers of our online postings: When you post messages on Our message boards, chat, profile pages, blogs, and other services to which you are able to post information and materials, these messages and materials are visible to other users and/or the general public (“Public Postings”) via the Services. Please note that any information you post or disclose via Public Postings will become public information. We urge you to be very careful when deciding to publicly disclose any information on the Services.
  • Government entities/law enforcement: We may share information when we believe in good faith that we are lawfully authorized or required to do so to respond to lawful subpoenas, warrants, court orders, or other regulatory or law enforcement requests, or where necessary to protect our property or rights or the safety of our employees, our customers, or other individuals.
  • Other businesses in the context of a commercial transaction: To a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).

Retention

We retain this personal information according to Our records retention schedule which sets retention periods for categories of personal information based on Our business needs and legal obligations.

Third Party Services

This Privacy Policy does not address, and We are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any site or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by Us or by Our affiliates.

In addition, We are not responsible for the information collection, use, disclosure or security policies or practices of other organizations, such as Facebook, Apple, Google, Microsoft, RIM or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider or device manufacturer, including with respect to any Personal Information you disclose to them in connection with the Services.

Our Advertising

We may use third-party advertising companies to serve advertisements regarding goods and services that may be of interest to you when you access and use the Services and other websites or online services, based on information relating to your access to and use of the Services and other websites or online services on any of your devices, as well as on information received from third parties. To do so, these companies may place or recognize a unique cookie on your browser (including through the use of pixel tags). They may also use these technologies, along with information they collect about your online use, to recognize you across the devices you use, such as a mobile phone and a laptop. We seek to use reasonable organizational, technical and administrative measures to protect information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with Us is no longer secure (for example, if you feel that the security of your account has been compromised), please immediately notify us in accordance with the “Contacting Us ” section below.

Choices And Access

Email Unsubscribe: You may opt out of receiving marketing emails from Us by following the instructions contained in each such email. In addition, certain Services may give you the ability to opt out through your account settings. We will try to comply with your request as soon as reasonably practicable. Please note that if you opt out of receiving marketing-related emails from Us, we may still send you important administrative messages, from which you cannot opt out.

Ad Choices: You have options to limit the information that We and Our partners collect for online advertising purposes.

  • You may disable cookies in your browser or mobile device using their settings menus. Your mobile device may give you the option to disable advertising functionality. Because We use cookies to support Services functionality, disabling cookies may also disable some elements of Our online properties.

Nor will exercising these options prevent other companies from displaying personalized ads to you. Moreover, We may not be able to recognize your computer, and you may need to enter your birthday every time you visit. You also may not receive advertising or other offers from Us that are relevant to your interests and needs.

Do Not Track Signals: Do Not Track Signals: Some web browsers have settings that include “do not track signals.” The Services are currently engineered to respond to those signals.

Other Rights: You may have certain rights with respect to your information. Please note that We may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion. Cross-Border Transfer

The Services are controlled and operated by Us from the United States and are not intended to subject Us to the laws or jurisdiction of any state, country or territory other than that of the United States. Your information may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Services you understand that your information may be transferred to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country.

Sensitive Information

We ask that you not send Us, and you not disclose, any sensitive information (e.g., Social Security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics or criminal background) on or through the Services or otherwise to Us.

California Privacy Rights

The California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), provides California residents with rights to receive certain disclosures regarding the collection, use, and disclosure of information about them, as well as rights to know/access, delete, correct, and limit the use and disclosure of personal information. You have the right to be free from discrimination based on your exercise of your CCPA rights. To the extent that We collect personal information that is subject to the CCPA, that information, Our practices, and your rights are described below.

Entities to whom We disclose information for business purposes are service providers, which are companies that We engage to conduct activities on Our behalf. We restrict service providers from using personal information for any purpose that is not related to Our engagement.

Entities to whom we “sell” or with whom we “share” information are third parties. Under the CCPA, a business “sells” personal information when it discloses personal information to a company for monetary or other benefit. A company may be considered a third party either because We disclose personal information to the company for something other than an enumerated business purpose under California law, or because its contract does not restrict it from using personal information for purposes unrelated to the service it provides to Us. A business “shares” personal information when it discloses personal information to a company for purposes of cross-context behavioral advertising.

Financial Incentives. We may offer you the opportunity to participate in sweepstakes, contests, or other promotions (collectively “Promotion(s)”) which are voluntary. If We do, we will obtain your consent to collect your personal information in connection with your participation. The category of personal information we collect is Personal Identifiers, which We use to facilitate your participation in the Promotion and market to you. If We run the Promotion jointly with a business partner, We may disclose the information to that business partner.

You may opt-in to Promotions using the means We present to you, such as an online registration page, at the time We make the offer. You may opt-out of Promotions at any time by following the instructions in the “Contacting Us” section.

The Promotion We offer may qualify as a Financial Incentive Program (“FIP”) under California law. We are required to explain how the value you receive from FIPs is reasonably related to the value that We receive from the personal information you provide to Us. We use the personal information you provide for marketing purposes, to better understand our consumers, and for other related purposes, including, but not limited to, direct marketing emails. We disclose the personal information you provide to business partners because it gives them an opportunity to find new audiences that may like their products. These activities generate revenue for Us that We believe is reasonably related to the benefit you receive from participating in the sweepstakes. Our good faith estimate is that the value of your personal information you provide is approximately equal to the value We receive in collecting said personal information. We calculated that value by looking at the potential additional marketing customization value to the consumer due to the enriched understanding of said consumer to determine the average value of the data based on the attribute collected. We believe this value is reasonable because it is based on internal data about the value of marketing leads and, if we disclose personal information to business partners, our calculation of the average value of said personal information.

Your rights under the CCPA

  1. Request to Know. You may request that We disclose to you the following information covering the 12 months preceding your request:
    • The categories of personal information We collected about you and the categories of sources from which We collected such personal information;
    • The specific pieces of personal information We collected about you;
    • The business or commercial purpose for collecting or selling (if applicable) personal information about you;
    • The categories of personal information about you that We sold and, for each, the categories of third parties to whom We sold such personal information (if applicable); and
    • The categories of personal information about you that We otherwise shared or disclosed, and, for each, the categories of third parties with whom We shared or to whom We disclosed such personal information (if applicable).
  2. Request to Delete. You may request that we delete personal information We collected from you.
  3. Request to Correct. You may request that We correct inaccurate personal information that We have collected about you.

We will verify and respond to your request consistent with applicable law taking into account the type and sensitivity of the personal information subject to the request. We may need to request additional personal information from you, such as the email address you provided to Heineken, in order to verify your identity and protect against fraudulent requests. If you make a Request to Delete, We may ask you to confirm your request before We delete your personal information.
  4. If you are the authorized agent of a California resident, making a Request to Know, Delete, or Correct on behalf of the resident, we may ask you to show that you are authorized to make the request on behalf of a consumer.
  5. Request to Opt Out of Sale or Sharing. You may request to opt out of future “sale” or “sharing” of personal information about you by clicking here or call us at 1-833-983-5070.
  6. Right to Non-Discrimination. You have the right to be free from unlawful discriminatory treatment for exercising your rights under the CCPA.
  7. Right to Request Information About Our Information Sharing.
    Under California Civil Code section 1798.83, California residents have the right to request and receive from Heineken, once a year, free of charge, information about the personal information we have disclosed (if any) to third parties for their marketing purposes during the previous calendar year, and a description of the categories of personal information shared.   8. Right to Limit the Use of Sensitive Personal Information.
    You have the right to limit our use of your sensitive personal information if we use such information to infer characteristics about you. We do not use your sensitive personal information for this purpose.

Nevada Privacy Rights

Residents of the State of Nevada have the right to opt out of the sale of certain pieces of their information to third parties. If you are a Nevada resident and would like more information about our data sharing practices, please contact us. Currently, we do not engage in sales as defined under Nevada law.
